Alcorn County Justice Court processes one of the higher DUI caseloads in northeast Mississippi. Our review of public court records identified more than 300 DUI cases in the docket period reviewed, with a notable number of warrant dispositions among them. For a county that sits directly on the Tennessee state line, the volume is not surprising—but the number of people who end up with convictions, warrants, and suspended licenses they never knew about is a serious problem.
If you were arrested for DUI in Alcorn County and later convicted without ever going to court, you need to understand what happened and what you can do about it.
Public records from Alcorn County Justice Court reveal a docket with more than 300 DUI cases in the period reviewed. Among those cases, a significant number resulted in warrant dispositions—meaning the defendant did not appear, the court entered a conviction or issued a bench warrant, and the case remains unresolved from the defendant’s perspective.
Three hundred cases is a substantial docket for a county of Alcorn’s size. The volume reflects several factors unique to this area: Alcorn County’s position on the Tennessee border means it sees significant cross-state traffic. Corinth, the county seat, sits at the intersection of Highway 72 and Highway 45, drawing traffic from both states. People arrested for DUI in Alcorn County may live in Corinth, Rienzi, Glen, or Kossuth—or they may be Tennessee residents who were passing through. For out-of-state defendants in particular, the risk of missing a court date and being convicted in absence is especially high.
Alcorn County’s proximity to the Tennessee state line creates a specific problem for DUI defendants. A Tennessee resident arrested for DUI in Alcorn County may post bond and return home across the state line. If the court’s notice of the court date is mailed to an address that has changed, or if the defendant does not understand the Mississippi court process, the case can proceed without them. Mississippi Code Annotated § 99-17-9 authorizes justice courts to try defendants in their absence if they were “notified in writing by the proper officer”—but when the defendant lives in another state, the question of whether that written notice actually reached them becomes especially important.
A conviction entered in Alcorn County Justice Court follows a Tennessee resident across state lines. The Mississippi Department of Public Safety reports the conviction to Tennessee’s Department of Safety under the interstate Driver License Compact, which can trigger license consequences in the defendant’s home state. A bench warrant issued by Alcorn County will appear in the National Crime Information Center database, which means it can surface during any interaction with law enforcement in any state.
If you were convicted of a DUI in Alcorn County Justice Court without ever appearing—whether you live in Alcorn County or across the state line in Tennessee—you have the right to appeal that conviction for a de novo trial in circuit court under Rule 29.1(a) of the Mississippi Rules of Criminal Procedure. The appeal must be filed within 30 days of the judgment. If that deadline has passed, other legal avenues may be available depending on the facts of your case, particularly where proper notice was not provided.
