If you’re a truck driver passing through DeSoto County on I-55, you need to know about a serious problem: predatory towing operations are targeting commercial vehicles at truck stops and gas stations in this gateway area between Tennessee and Mississippi.
DeSoto County sits right at the Mississippi border, making it a major corridor for commercial traffic heading south from Memphis on I-55. This location makes it attractive to predatory towing operations that exploit the vulnerability of drivers stopping for fuel, food, or rest. Drivers may park at what appears to be a legitimate truck stop or gas station, only to return to find their vehicle gone. The towing company then demands immediate cash payment—sometimes thousands of dollars—with little documentation of their legal authority to tow.
These operations use private parking lots, work with parking management companies, and often use aggressive intimidation tactics. In some cases, vehicles have been transported across state lines, titles have been fraudulently transferred, and vehicles have been sold at auction without the rightful owner’s consent. This isn’t speculation—it’s documented in federal litigation and news coverage.
In March 2024, major trucking companies filed a federal RICO lawsuit in the Western District of Tennessee against A-1’s Towing, CAC Operations, S-Line, and related entities. The lawsuit alleges a coordinated scheme targeting commercial trucks along the I-55 corridor, including operations affecting drivers passing through DeSoto County. The lawsuit names damages exceeding $5 million and alleges organized, systematic targeting of trucking company vehicles.
Memphis city government has also taken action, suspending operating permits for key players in these towing operations. Tennessee Highway Patrol and Memphis Police have conducted ongoing investigations since October 2023. News outlets including WREG-TV, Overdrive, and FreightWaves have extensively documented these schemes.
Do not panic, and do not immediately pay cash. Here’s what to do:
Mississippi law protects vehicle owners from unauthorized towing. If a tow company cannot demonstrate legal authority—through a valid contract with the property owner, posted signage meeting legal requirements, or violation of clearly stated parking regulations—they may be liable for conversion (essentially, theft) and other damages.
If you paid cash for an unauthorized tow, you may be able to recover that money. If your vehicle was damaged during the tow, transported without authorization, or if the title was transferred improperly, you have additional claims.
If your vehicle was towed in DeSoto County under questionable circumstances, you don’t have to accept it. Contact Weldy Law Firm to discuss your rights and potential recovery.
