Was Your Truck Towed from a Memphis-Area Truck Stop? You May Have Legal Options

If you’ve been towed from a gas station, truck stop, or parking lot in the Memphis area or along I-55 in Mississippi, you are not alone. This is part of a widespread pattern of predatory towing that is now the subject of federal litigation and ongoing law enforcement investigations.

You Are Not the Only Victim

In March 2024, a federal lawsuit was filed in the U.S. District Court for the Western District of Tennessee. The lawsuit was brought by three major trucking companies: Western Express, MHT Group, and Church Transportation. These companies sued A-1’s Towing & Hauling, CAC Operations LLC, and S-Line LLC—the operators of the predatory towing scheme.

This is not a single case. This is a federal RICO (racketeering) lawsuit alleging an organized conspiracy to steal commercial vehicles, defraud trucking companies, and use unlawful means including armed intimidation to operate the scheme.

News coverage from WREG-TV Memphis, Overdrive Magazine, FreightWaves, and CDLLife has documented these operations. The Tennessee Highway Patrol and Memphis Police Department launched a joint criminal investigation in October 2023. Memphis city officials suspended towing permits for some of the operators involved.

If your truck was towed, your experience may be part of this larger pattern.

What the Lawsuit Alleges

The federal lawsuit alleges that the defendants operated a coordinated scheme to:

  • Target commercial truck drivers at truck stops and gas stations
  • Tow vehicles under questionable or fraudulent authority
  • Charge excessive fees
  • Use armed employees to intimidate drivers
  • Refuse to return vehicles or demand immediate payment
  • Transport vehicles across state lines to frustrate recovery
  • Fraudulently transfer vehicle titles
  • Sell or auction stolen vehicles

This is not a dispute over a legitimate parking fee. This is alleged organized criminal activity targeting an entire industry.

Why This Matters to You

If your truck was towed from a truck stop or gas station in the Memphis area or along I-55, you may have legal claims. Even if you already paid the demanded fee, you may be able to recover that money. Even if your truck was auctioned or sold, you may be able to recover its value.

The existence of the federal lawsuit and ongoing investigations means:

  1. Your experience is documented. Other drivers have experienced the same thing, and that pattern strengthens your claim.

  2. There is ongoing investigation. Law enforcement agencies are actively investigating these operations. Your case may connect to criminal charges.

  3. Multiple legal theories apply. You may have claims for conversion, fraud, breach of contract, and federal civil rights violations.

  4. Damages may include more than your truck’s value. You may recover lost income, emotional distress, and punitive damages.

What Damages May Be Available

If you were a victim of predatory towing, you may be entitled to recover:

Vehicle Value. The fair market value of your truck at the time it was towed.

Towing and Storage Fees. All fees paid to the towing company, especially if paid under duress or threat.

Lost Business Income. Lost income from days or weeks your truck was unavailable, preventing you from working.

Repair Costs. If your truck was damaged while in the towing company’s possession.

Emotional Distress and Other Non-Economic Damages. Your suffering, anxiety, and disruption to your life.

Punitive Damages. In cases involving fraud, racketeering, or intentional misconduct, courts may award punitive damages to punish wrongdoing and deter future misconduct.

You May Recover Even If You Already Paid

Many victims of predatory towing pay the demanded fee under duress—meaning they felt threatened or had no safe choice but to pay. Money paid under duress can be recovered through a legal claim. You should not assume that because you paid, you have no recourse.

Similarly, if your truck was eventually sold or auctioned, you may still pursue a claim for its value. The fact that the truck is gone does not eliminate your legal rights.

Time Is Important

If you’ve been the victim of predatory towing, do not delay in seeking legal advice. Evidence deteriorates over time. Memories fade. Witnesses become harder to locate. Documentation may be lost.

Additionally, legal claims are subject to time limits called statutes of limitations. The sooner you contact an attorney, the sooner your claim can be properly documented and preserved.

What You Should Do

Gather Your Evidence. Collect all documentation related to the towing: receipts, emails, text messages, photos, police reports, witness contact information, and written descriptions of what happened.

Do Not Delay. Contact an attorney as soon as possible. A prompt consultation can preserve your rights and protect your claim.

Be Honest About Details. When you speak with an attorney, be honest about what happened. Include details that might seem unimportant—they may become crucial to your case.

Expect Professional Guidance. An experienced attorney can evaluate your specific situation, explain your legal options, and advise whether you have a viable claim.
